TRADEMARK / Intellectual Property (IP)

Types of Intellectual Property

1. Patents

2. Trademarks

3. Copyright

4. Designs

Patents protect what makes things work - like what makes a wheel turn or the chemical formula of your favourite fizzy drink

Trade marks are signs (like words and logos) that distinguish goods and services in the marketplace.

Copyright is an automatic right which applies when the work is fixed, that is written or recorded in some way.

Designs protect the appearance of a product/logo, from the shape of an aeroplane to a fashion item

How to Register a Trademark

Multiple Choice Accountancy can take you through this process with just a few easy online trademark registration steps. Your application will provide details of the goods and services to be protected, the name and address of who you want the trademark to be assigned to, and that the statutory fees have been paid.

After the online trademark registration process is complete it is then examined to ensure that it meets the demands of the Trade Marks Act, and then a search is undertaken to identify earlier similar trade marks. The Registrar then produces a report identifying any deficiencies in the application and allowing one attempt to overcome earlier marks.

The Registrar then advertises the application for two months to allow for opposition by third parties. The Examiner will notify the owners of the trademark registration application of earlier UK and (some) Community rights that have been maintained as objections against the application of the advertisement.

If there aren't any objections after the trademark application is advertised, it will be registered for 10 years from the date of registration.
